Standard B2B terms. Pilot and Enterprise agreements supersede.
These terms cover use of the Fonteum Data Platform when no individually-negotiated agreement is in force. Pilot agreements (90-day) and signed Enterprise master service agreements supersede these terms wherever they conflict.

1. The data product
Fonteum Data Platform ("the Platform") provides aggregated, normalized, and source-provenanced data derived from public regulatory registries — including but not limited to the CMS National Plan and Provider Enumeration System (NPPES), CMS Care Compare, state professional licensing boards, U.S. Census Bureau population estimates, and public-domain federal labor and economic statistics. The Platform handles only public records.
2. Data licensing scope
Subject to your tier and any individually-negotiated agreement:
- Pilot tier — internal use during the 90-day pilot window.
- Standard tier — internal commercial-product use covered for the term of the subscription.
- Enterprise tier — scope per signed master service agreement.
Resyndication or redistribution to third parties (including hosted public datasets, aggregated competitor products, or downstream API offerings) requires a separate signed agreement.
3. Acceptable use
- You agree not to scrape the Platform's web surfaces or API beyond the rate limits and scope defined in your tier.
- You agree not to use Platform data to harass, defame, or otherwise harm any provider listed in the underlying registries.
- You agree not to use Platform data to assemble a marketing-list product targeting providers for solicitation in violation of state contractor-licensing-board terms (CSLB and several state boards prohibit solicitation use of bulk lists).
- You agree not to use Platform data in any product that misrepresents Fonteum as having checked, certified, or otherwise endorsed any individual provider beyond the explicit source provenance we publish.
4. Attribution
Public-facing use of Platform data must include attribution to "Fonteum Research" with a link to fonteum.com on the same page. Internal-only use does not require attribution. The underlying public-domain federal sources retain their own citation conventions; Fonteum attribution is in addition to, not in place of, those.
5. Warranties + limitations
The Platform is provided "as is." Fonteum makes no warranty that the data is complete, error-free, or current beyond the explicit last_checked timestamps published on each record. Source registries occasionally publish errors, and Fonteum will reflect those errors until the registry corrects them or a customer reports the discrepancy via corrections@fonteum.com.
Fonteum's aggregate liability is limited to the fees paid in the trailing twelve (12) months. Pilot agreements may set a lower cap.
6. Termination
Either party may terminate with thirty (30) days' written notice. Pilot agreements include explicit no-penalty termination during the 90-day window. Upon termination, customer access to the Platform ceases at the end of the current billing period; data already integrated into customer systems may be retained per the licensing scope of the prior tier (internal use only) but cannot be refreshed.
7. Confidentiality
Both parties agree to keep non-public business information shared during the engagement (pricing, customer roster, integration architecture) confidential for the duration of the agreement and for two (2) years thereafter. Pilot agreements layer a mutual NDA on top of this clause.
8. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws provisions. Any dispute arising from or related to these terms shall be resolved in the state or federal courts located in San Francisco County, California.
9. Pilot and Enterprise agreements supersede
Where a signed pilot agreement (90-day) or Enterprise master service agreement is in force, the terms of that agreement supersede these standard terms wherever the two conflict. Standard terms apply only where the signed agreement is silent.
10. Changes
Fonteum may update these terms with 30 days' notice to active subscribers. The "Last updated" date at the top of this page reflects the current version. Pilot and Enterprise customers operate under the terms in their signed agreement until that agreement renews.
